Abu dhabi: The ADGM Registration Authority (RA) has introduced the Administrative Regulations 2025 (Admin Regulations) along with amendments to existing commercial legislation.
According to Emirates News Agency, these new regulations and legislative enhancements provide a comprehensive solution aimed at refining the RA's statutory framework. This development addresses contraventions, sanctions, and enforcement procedures, streamlining the previous framework and ensuring uniformity across ADGM's commercial laws.
The Admin Regulations feature several key improvements, including the consolidation and enhancement of the RA's investigation and information-gathering powers. The regulations also update fine levels and administrative sanctions to better match the nature and severity of contraventions. Additionally, a two-tiered approach to contraventions is introduced, allowing for differentiated enforcement processes based on the severity of the violations.
Moreover, the RA's supervisory and enforcement capabilities have been bolstered to ensure that actions are concluded in a transparent and efficient manner. A statutory emergency process has also been introduced, granting the RA CEO the authority to act swiftly in cases of exceptional urgency. Furthermore, the regulations now include a statutory power that allows the RA to enter into settlement agreements, with a clearly defined settlement process.
The enactment of the Admin Regulations, along with the amendments to the relevant ADGM Regulations, and the repeal and replacement of the Commercial Licensing Regulations and relevant ADGM Rules, are effective immediately upon publication.
